To place an order on our website you must follow the steps below. Our ordering process allows you to check the information provided and correct it before confirming the order.

Step 1: Add product to online shopping basket.

Step 2: Click on the basket and then select ‘Order’.

● Step 3: If you do not have an account, click on ‘Yes, I am interested’ in the proposal ‘Create an account‘. Then click on ‘No account? Create one’ and enter your details. If you do have an account, identify yourself.

Step 4: Select the delivery method.

Once the payment has been confirmed, you will receive an email from us confirming receipt of payment. The order is accepted when you receive an email from us stating that the order has been shipped with the tracking number and carrier used. If we are unable to provide you with a product because it is no longer in stock or has a price or description error, we will notify you by email as soon as possible to cancel your order and make a refund as soon as possible.

7. TERMS OF PAYMENT

All orders placed on the Obvious Parfums site must be paid when the order is placed. The following payment methods are accepted:

When selecting the bank card payment method, the payment form, powered by Stripe, will be displayed. This secure payment platform encrypts card details that we do not have access to. Depending on the bank, the customer may be redirected to a bank authentication page before the payment is approved. This system is called 3D Secure and allows your bank to verify the identity of the cardholder before the transaction. The authentication process to be followed is specific to each bank: you may be asked to enter your date of birth, a code received by SMS or answer a personal question. Please note that after 3 authentication failures, your card will be blocked.

We accept the following bank cards: Visa, Mastercard, American Express, Discover, Diners Club, JCB et China UnionPay.

When you select the PayPal payment method, you will be redirected to the PayPal login page to accept payment of your customer account.

8. SAMPLES

For all orders we offer samples of the perfume(s) purchased to allow you to try before opening the product sold and return it to us if it does not suit you.

Delivery costs and times vary depending on the delivery address and delivery method chosen and the type of product (online exclusive or not). This information is given on our website and displayed at the time of ordering. You can track your parcel at any time by entering your parcel number on the carrier's website, the coordinates of which you can find in your shipping confirmation email. In order for delivery deadlines to be met, you must ensure that you have provided full and accurate information on the delivery address (street, building, staircase numbers, access codes, names, intercom numbers, etc.). However, if we are unable to meet the estimated delivery date, we will inform you of a new date.

DEFECTIVE PRODUCT 

We have a legal obligation to supply products that comply with the order we have accepted. If your purchase is defective or broken on arrival, we advise you to inform us as soon as possible in order to benefit from your legal consumer rights. If we agree with you following a review of the returned product, we will either offer to replace the product free of charge or refund it and the shipping costs you have paid to return it to us.

10. RIGHT TO WITHDRAW, RETURN AND REFUND

In accordance with Article L.221-18 of the Consumer Code, you have the right to change your mind within 14 days of receiving your order, as outlined below, without needing to provide any reason.

However, per Article L.221-18 of the Consumer Code, this right does not apply to products that have been unsealed after delivery and cannot be returned for hygiene or health reasons.

RETURN AND REFUND PROCESS

Following communication of the decision to withdraw, the order must be returned within 14 days. The product you wish to return must be intact, unopened and in its original packaging. Please note that no products purchased on the site may be returned to the store. Here are the steps you need to follow to cancel your order and return the product :

  • Print out the return slip and send your parcel.
  • Once your parcel has been dispatched, you can track the progress of your return through your customer account.

Any refund will be made once the parcel has been received by our teams in good condition.

Please note, we are not responsible for any loss or damage during return shipping and reserve the right to withhold reimbursement. We recommend protecting the product, sending it via registered mail, and keeping proof of shipment until your refund is processed.

11. LEGAL GUARANTEES

In accordance with the legal provisions in force, we will refund or exchange products that are defective, non-compliant or do not correspond to your order. 

The products sold on our site are subject to the conditions of legal guarantee provided for under Articles L 211-4, L 211-5 and L 211-12 of the Consumer Code as well as Articles 1641 and 1648 of the Civil Code:

Article 1641 Civil Code: The seller is bound by the guarantee because of hidden defects in the thing sold which render it unfit for the purpose for which it is intended, or which impair this use so much that the buyer would not have acquired it, or would only have given a lower price for it, if he/she had known of them.

Article 1648 of the Civil Code: Any action resulting from prohibitive defects must be brought by the buyer within a period of two years from discovery of the defect. In the case provided for under Article 1642-1, the action must be brought, under penalty of foreclosure, within the year following the date on which the seller can be discharged from liability for apparent defects.

Article L211-4 of the Consumer Code: The seller is obliged to deliver goods that comply with the contract and is liable for any non-compliance existing at the time of delivery. They are also liable for any non-compliance resulting from the packaging, the assembly instructions or the installation when this is placed under its responsibility under the contract or is carried out under its responsibility.

Article L211-5 of the Consumer Code: To comply with the contract, the item of goods must:

- be specific to the usual expected use of a similar item of goods and, where applicable, correspond to: the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect in view of the public declarations made by the seller, by the producer or by its representative, in particular in advertising or labelling;

- present the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, which has been brought to the knowledge of the seller and which the latter has accepted.

Article L211-12 of the Consumer Code: Actions resulting from non-compliance must be brought within two years of delivery of the item of goods.

12. LIABILITY

Différentes Latitudes INC may not be held responsible for any indirect damage that may occur as a result of the purchase of products, the consequences linked to use that is not in accordance with the use for which the product is intended or defects of the products and their consequences linked to any external cause. Différentes Latitudes INC may not be held liable for the non-performance or poor performance of contracts where this is attributable either to the consumer, or to a case of force majeure, or to the unforeseeable and insurmountable actions of a third party to the contract.
