The products offered for sale are those described on our website, subject to available stock. Stock levels are regularly updated. However, a stock error does not engage the liability of Obvious Parfums and, as such, Obvious Parfums cannot be held responsible for the cancellation of an order for a product due to stock depletion.

The product visuals on our website are not contractual; they are provided for illustrative purposes only and may slightly differ from the products received. We strive to provide the most accurate description possible to best meet customer information needs.

3. PRICES

The prices of all our products are denominated in euros and include VAT (VAT applicable on the day of the order); any change in the legal VAT rates will be reflected in product prices from the date stipulated in the relevant implementing decree.

6. FORMATION OF THE CONTRACT BETWEEN THE TWO PARTIES

The contract between the two parties (customer and Obvious Parfums) is concluded upon receipt of the email confirming that the products have been shipped. To place an order on our website, you must follow the steps below. Our order process allows you to review the information and make corrections before confirming your order.

Bank card payments on the website are secure and are processed via the PayZen payment system and Franfinance for installment payments.

FULL PAYMENT

LATE OR FAILED DELIVERY

Any delivery defect or delay of more than 7 days must be reported to our customer service team as soon as possible.

DEFECTIVE PRODUCT 

We have a legal obligation to provide products that conform to the order we have accepted. If your purchase is defective or arrives broken, we advise you to notify us as soon as possible so you can benefit from your legal consumer rights. Send us an email at contact@obviousparfums.com attaching photos of your defective product. If we agree with you following an examination of the returned product, we will offer you either a free replacement or a full refund, including the shipping costs you paid to return it to us.

10. RIGHT OF WITHDRAWAL, RETURN AND REFUND

RIGHT OF WITHDRAWAL

In accordance with Article L.221-18 of the French Consumer Code, you have the right to change your mind within 14 days from the date of receipt of the order, without having to provide a reason, in accordance with the conditions set out below.

In accordance with Article L.221-18 of the French Consumer Code, the right of withdrawal cannot be exercised for orders involving the supply of products that have been unsealed after delivery and cannot be returned for hygiene or health protection reasons.

RETURN

Following notification of the decision to withdraw, the order must be returned within 14 days. The product you wish to return must be intact, unopened and in its original packaging. Please note that return shipping costs are your responsibility outside of metropolitan France and that no product purchased on the website can be returned in store. 

Here are the steps to follow to withdraw from your purchase and return your order.

Step 1: Send your withdrawal request to the email address contact@obviousparfums.com specifying the order number, first name and last name.

Step 2: Send the package with the prepaid shipping label provided by us. The package must contain the product in perfect condition, unused, in its original packaging along with the purchase invoice. 

Step 3: Refund to the same payment method used for the purchase, once the parcel has been received by us and the product meets the following criteria: intact, unopened and in its original packaging. Any item not meeting these criteria will not be eligible for a refund. 

Please note that we will not be held responsible for any loss or damage incurred during the transport of the returned product, and we reserve the right not to issue a refund. We therefore recommend that you carefully protect the product and send it by registered mail, keeping proof of shipment until your refund has been processed. 

REFUND

The refund will be processed within 7 business days to the same payment method. You will receive an email notifying you that the refund has been made.

11. LEGAL WARRANTIES

In accordance with applicable legal provisions, we will refund or exchange defective products, non-conforming products, or products that do not match your order. 

The products sold on our website are subject to the legal warranty conditions set out in Articles L 211-4, L 211-5 and L 211-12 of the French Consumer Code, as well as Articles 1641 and 1648 of the French Civil Code:

Article 1641 of the French Civil Code: The seller is bound by the warranty for hidden defects in the item sold that render it unfit for the purpose for which it was intended, or that so diminish that use that the buyer would not have purchased it, or would have paid a lower price, had they known of them.

Article 1648 of the French Civil Code: The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect. The company Différentes Latitudes cannot be held liable for any indirect damage that may arise from the purchase of products, consequences related to use that does not conform to the intended purpose of the product, or product defects and their consequences linked to any external cause. The company Différentes Latitudes cannot be held liable for non-performance or improper performance of the contract attributable either to the consumer, to force majeure, or to the unforeseeable and unavoidable act of a third party to the contract.

Nullity of a contractual provision

Waiver

Step 3: Refund to the same payment method used for the purchase, once the parcel has been received by us and the product meets the following criteria: intact, unopened and in its original packaging. Any item not meeting these criteria will not be eligible for a refund. 

Please note that we will not be held responsible for any loss or damage incurred during the transport of the returned product, and we reserve the right not to issue a refund. We therefore recommend that you carefully protect the product and send it by registered mail, keeping proof of shipment until your refund has been processed. 

REFUND

The refund will be processed within 7 business days to the same payment method. You will receive an email notifying you that the refund has been made.

11. LEGAL WARRANTIES

In accordance with applicable legal provisions, we will refund or exchange defective products, non-conforming products, or products that do not match your order. 

The products sold on our website are subject to the legal warranty conditions set out in Articles L 211-4, L 211-5 and L 211-12 of the French Consumer Code, as well as Articles 1641 and 1648 of the French Civil Code:

Article 1641 of the French Civil Code: The seller is bound by the warranty for hidden defects in the item sold that render it unfit for the purpose for which it was intended, or that so diminish that use that the buyer would not have purchased it, or would have paid a lower price, had they known of them.

Article 1648 of the French Civil Code: The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect. In the case provided for by Article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller may be discharged of liability for apparent defects.

Article L211-4 of the French Consumer Code: The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, the assembly instructions, or the installation when the latter has been assigned to them under the contract or has been carried out under their responsibility.

Article L211-5 of the French Consumer Code: To conform to the contract, the goods must:

- Be fit for the purpose ordinarily expected of similar goods and, where applicable, correspond to: the description given by the seller and possess the qualities presented by the seller to the buyer in the form of a sample or model; present the qualities that a buyer can legitimately expect in light of public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;

- Present the characteristics agreed upon by the parties or be fit for any special use sought by the buyer, brought to the seller's attention and accepted by the seller.

Article L211-12 of the French Consumer Code: The action resulting from a lack of conformity is time-barred two years after delivery of the goods.

12. LIABILITY

The company Différentes Latitudes cannot be held liable for any indirect damage that may arise from the purchase of products, consequences related to use that does not conform to the intended purpose of the product, or product defects and their consequences linked to any external cause. The company Différentes Latitudes cannot be held liable for non-performance or improper performance of the contract attributable either to the consumer, to force majeure, or to the unforeseeable and unavoidable act of a third party to the contract.

13. INTELLECTUAL PROPERTY

The Différentes Latitudes brand, as well as all trademarks, photographs, illustrations, logos, designs and models, copyrights, and content appearing on the site are the exclusive property of the company Différentes Latitudes and/or the relevant intellectual property rights holder.

Any total or partial reproduction of the Différentes Latitudes brand, as well as all brands, photographs, illustrations, logos, drawings and models, copyrights, and content appearing on the website, is strictly prohibited without the express, written and prior consent of the company Différentes Latitudes and/or the holder of the relevant intellectual property rights, and would constitute an infringement. Any hypertext link to this website, or using framing or hotlinking (in-line linking) techniques, is strictly prohibited without the express, written and prior authorization of the company Différentes Latitudes.

14. GENERAL PROVISIONS

Entire agreement 

The parties acknowledge that this contract constitutes the entire agreement concluded between them.

Nullity of a contractual provision 

If any provision of these General Terms and Conditions of Sale were to be declared null and void, such nullity would not affect the validity of the remaining provisions of the General Terms and Conditions of Sale, which shall remain in force.

Waiver 

The fact that the company Différentes Latitudes refrains from requiring the performance of any of the provisions of these General Terms and Conditions of Sale cannot be interpreted as a waiver of the right to subsequently invoke non-performance of the provision in question.

Amendment

The company Différentes Latitudes reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the website. In the event of modification, the applicable General Terms and Conditions of Sale are those online on the website at the date of order validation.

15. APPLICABLE LAW AND DISPUTES

These General Terms and Conditions and the related sales are governed by French law. Any dispute relating to the existence, interpretation, performance or termination of the contract concluded between the company Différentes Latitudes and the consumer, even in the event of multiple defendants, shall, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the Paris courts.
